Sharia Law Strikes: Killing Wives vs Stealing Rams

A day at the courts. Arab News reports the verdicts of two different cases in the same day as follows:

  1. Two thieves who stole two rams were sentenced to three years imprisonment and 1,000 lashes each
  2. A husband beat his wife to death was sentence to two years imprisonment and 200 whiplashes

Death Sentence for ‘un-Islamic material on Women’s Rights’

In Kabul’s grim and crowded central prison, a 23-year-old student from northern Afghanistan spends each day wondering if and when he will be put to death.

Sayed Pervez Kambaksh was sentenced in January, in five minutes, at a local court in Mazar-e-Sharif, with no legal representation to defend charges of blasphemy after reports he had downloaded from the internet un-Islamic material on women’s rights.

“I don’t know what will happen to me,” he said from the prison office where we were allowed half an hour to interview him.

“My trial was unfair from the beginning. From day one, they have been treating me very harshly as a criminal, not a suspect, and I don’t know who has done this to me.

“My case has been politicised – my lawyer has been threatened. I have lost nine months of my life now in four prisons,” he said.

Fatwa of the Month: Islam allows Rape and Wife Beating

Husband forcing his wife to have intercourse

Is it permissible for a man to force his wife or slave to have intercourse if she refuses?.

Praise be to Allaah.

The woman does not have the right to refuse her husband, rather she must respond to his request every time he calls her, so long as that will not harm her or keep her from doing an obligatory duty.

Al-Bukhaari (3237) and Muslim (1436) narrated that Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him)  said: “If a man calls his wife to his bed and she refuses, and he spends the night angry with her, the angels curse her until morning.”

If she refuses with no excuse, she is disobeying and is being defiant (nushooz), and he is no longer obliged to spend on her and clothe her.

The husband should admonish her and remind her of the punishment of Allaah, and forsake her in her bed. He also has the right to hit her, in a manner that does not cause injury. Allaah says (interpretation of the meaning):

“As to those women on whose part you see ill-conduct, admonish them (first), (next) refuse to share their beds, (and last) beat them (lightly, if it is useful); but if they return to obedience, seek not against them means (of annoyance). Surely, Allaah is Ever Most High, Most Great”

Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) was asked what a husband should do if his wife refuses him when he asks for intimacy.

He replied:

It is not permissible for her to rebel against him or to withhold herself from him, rather if she refuses him and persists in doing so, he may hit her in a manner that does not cause injury, and she is not entitled to spending or a share of his time [in the case of plural marriage].” Majmoo’ al-Fataawa, 32/279.

And he was asked about a man who has a wife who is rebellious and refuses intimacy – does she forfeit the right to maintenance and clothing, and what should she do?

He replied:

She forfeits her right to maintenance and clothing if she does not let him be intimate with her. He has the right to hit her if she persists in being defiant. It is not permissible for her to refuse intimacy if he asks for that, rather she is disobeying Allaah and His Messenger (by refusing). In al-Saheeh it says: “If a man calls his wife to his bed and she refuses, the One Who is in heaven will be angry with her until morning comes.”

So the wife should be admonished first, and warned against defiance (nushooz) and of the anger of Allaah and the curse of the angels. If she does not respond, then the husband should forsake her in her bed, and if she does not respond to that, then he may hit her in a manner that does not cause injury. If none of these steps are effective, then he may stop spending on her maintenance and clothing, and he has the right to divorce her or to allow her to separate from him by khula’ in return for some financial settlement, such as giving up the mahr.

Similarly a slave woman does not have the right to refuse her master’s requests unless she has a valid excuse. If she does that she is being disobedient and he has the right to discipline her in whatever manner he thinks is appropriate and is allowed in sharee’ah.

Nine Adulterers to Be Stoned (Iran)

Eight women and one man convicted of adultery are set to be stoned to death in Iran, according to activists and lawyers.

Shadi Sadr, a lawyer and women’s rights activist, said the nine were convicted of adultery in separate cases in different Iranian cities.

“Their verdicts are approved, and they may be executed at any time,” she said, adding that trial protocol was not applied properly in the cases.

Six of the nine were convicted based solely on judges’ decisions with no witnesses or the presence of their lawyers during their confessions, she said.

Most of the nine come from areas of Iran that have low rates of literacy and some did not understand the cases against them, she said. One had pleaded guilty to adultery even though she did not know the meaning of the charge.

The nine are between 27 and 50 years old, among them a male music teacher who was convicted of adultery for having an affair with one of his students, the activists said.

“We are trying to stop the implementation of their verdicts. And secondly, we want to amend the country’s penal law, in which death by stoning is prescribed,” she said.

Under Iran’s Islamic laws, adultery in the only capital offence punishable by stoning. Other capital offences in Iran include murder, rape, armed robbery, apostasy, blasphemy, drug trafficking, prostitution, treason and espionage.

The punishment is also applied in some other countries such as Saudi Arabia, United Arab Emirates, Sudan and Nigeria.

A man is usually buried up to his waist, while a woman is buried up to her neck. Those carrying out the verdict then throw stones until the condemned dies.

Stoning was widely imposed in the early years after Iran’s 1979 Islamic revolution. But in recent years, it has seldom been applied, though the government rarely confirms when it carries out stoning sentences. The last stoning death confirmed by the government was in July last year.

Sexual Harassment in Egypt (Hijab won’t stop it)

Almost half of Egyptian women are sexually harassed on a daily basis with more than half of Egyptian men admitting lewd behaviour, the Egyptian Centre for Women’s Rights said on Thursday.

The group polled 2,020 people — including men and foreign women — in Cairo, and the centre’s director, Nihad Abul Qomsan, said that the figures showed harassment was on the rise.

Of those surveyed, 83 percent of Egyptian women and 98 percent of foreign women said they had been harassed at some point, while 46 percent of Egyptian women and 52 percent of foreign women said they were harassed daily.

Most women said they were harassed in the street or on public transport, with harassment defined as “any unwelcome behaviour of a sexual nature which makes women feel uneasy and gives them a feeling of insecurity.”

Abul Qomsan said that almost two-thirds of Egyptian men — 62 percent — admitted harassing women, including those wearing Islamic headscarves.

“This shows that the belief that harassment is linked to women who wear indecent clothing is false,” she said, condemning the fact that in the deeply religious country women often feel responsible despite being victims.

The centre said that last year only 12 percent of women went to the police with a harassment complaint.

In 2006, women’s rights activists angrily spoke out against what they called the authorities’ acceptance of sexual harassment against women, after a mob of men openly molested women in central Cairo.

The interior ministry said it did not receive any formal complaints and has never admitted any mass harassment occurred despite the incident being widely reported in the press and some bloggers posting footage on the Internet.

Clerics Warn Women Against Leaving Their Homes (Yemen)

A group of Yemeni clerics warned women from going outside of their homes. The order, they claim, is to protect society from “vice and sexual chaos”.

The clerics also said that political role for women contradicts Islamic values.

“We warn against opening the door for women, who will get out of their houses and mix with men,” the clerics stated in a booklet distributed during a meeting.

“Women getting out of their houses and mixing with men in places of work will lead to non-marital relations … loss of decency, adultery and illegal children,” the booklet said.

A question to these clerics would be- why is the onus on the women to give up her basic rights? A woman cannot cause a loss of decency or commit adultery without a man.  Shouldn’t they both be equally culpable?

It is this backwards thinking that does not do women any justice.
