Sharia Law Strikes: Killing Wives vs Stealing Rams

A day at the courts. Arab News reports the verdicts of two different cases in the same day as follows:

  1. Two thieves who stole two rams were sentenced to three years imprisonment and 1,000 lashes each
  2. A husband beat his wife to death was sentence to two years imprisonment and 200 whiplashes

I believe the verdicts speak for themselves.

Morals of Islam: Rape + Suicide = Paradise

A WOMAN suspected of recruiting more than 80 female suicide bombers has confessed to organising their rapes so she could later convince them that martyrdom was the only way to escape the shame.

Samira Jassam, 51, was arrested by Iraqi police and confessed to recruiting the women and orchestrating dozens of attacks.

In a video confession, she explained how she had mentally prepared the women for martyrdom operations, passed them on to terrorists who provided explosives, and then took the bombers to their targets.

“We arrested Samira Jassim, known as ‘Um al-Mumenin’, the mother of the believers, who was responsible for recruiting 80 women”, Major General Qassim Atta said.

“She confessed her responsibility for these actions, and she confirmed that 28 attempts had been made in one of the terrorists’ strongholds,” he said.

Samira Jassim was arrested on January 21. She is allegedly linked to the Ansar al-Sunnah insurgent group.

Two of the attacks for which Samira Jassim admitted responsibility in the video confession took place in Diyala province, in central Iraq, which is considered one of the most dangerous areas of the country.

The Associated Press reports US military figures indicate at least 36 female suicide bombers attempted or carried out 32 attacks last year. Women are often allowed through military checkpoints without being searched, making it easier for them to hide explosives under their traditional robes.

For once in my life I am speechless in regard to these abhorrent acts.

‘It’s OK to hit your Wife’, Australian Muslim Cleric Samir Abu Hamza

An Australian Muslim cleric is at the centre of controversy over a lecture where he directed his followers to hit their wives and force them to have sex. In an earlier lecture circulated on the internet last year, Hamza was also recorded instructing his followers that under Islamic law, a man can demand sex from his wives. This runs contrary to Australian law where both partners mutual unvitiated consent is required, even within marriage.

In response Hamza claimed his words where metaphoric – but is this so?

The fact that the Quran and Sunnah allow for a man to beat his wife for disobediance including refusing sexual interourse leads me to the fact that Hamza was merely being honest in the potrayal of his beliefs. However, it is cowardly of him to step back for the sake of PR.
The contentious aya (verse) of the Quran which justifies such abhorrent actions is Surah 4 aya 34:

Righteous women are therefore obedient, guarding the secret for God’s guarding. And those (women)  you fear may be rebellious admonish; banish them to their couches, and beat them. If they then obey you, look not for any way against
them; God is All-high, All-great.
Surah 4:34 (Arberry English Translation)

The ignorant Muslim apologist will respond in such a manner, ‘well, it says nothing about forced sex’.  In this case we examine the context in which the aya was revealed.  As many of you may know – the Quran contains no context and it is quite useless when removed from it so we must turn to the ahadith (traditions) and the tafsir.

This single aya sufficeintly justifies Hamza’s words in the Islamic context as explained by Ibn Kathir:

(As to those women on whose part you see ill conduct,) meaning, the woman from whom you see ill conduct with her husband, such as when she acts as if she is above her husband, disobeys him, ignores him, dislikes him, and so forth. When these signs appear in a woman, her husband should advise her and remind her of Allah’s torment if she disobeys him. Indeed, Allah ordered the wife to obey her husband and prohibited her from disobeying him, because of the enormity of his rights and all that he does for her. The Messenger of Allah said,

If I were to command anyone to prostrate before anyone, I would have commanded the wife to prostrate before her husband, because of the enormity of his right upon her.)

Al-Bukhari recorded that Abu Hurayrah said that the Messenger of Allah said,

If the man asks his wife to come to his bed and she declines, the angels will keep cursing her until the morning.)

Muslim recorded it with the wording:
If the wife goes to sleep while ignoring her husband’s bed, the angels will keep cursing her until the morning.
This is why Allah said:

As to those women on whose part you see ill conduct, admonish them (first), abandon them in their beds, (then) beat them.
(This is surah 4 aya 34)

Accused Rapist: “She Made Me Interested”

Another story of Islamic culture impeding on basic human rights in the west. Throughout the Islamic world the guilt is placed on the women thus allowing men to get away with rape and other abhorrent acts of abuse.

By Nicky Park

A CABBIE accused of dragging a teenage girl into the back of his taxi and raping her said she had made him interested in her, a court was told.

Giving evidence in the New South Wales District Court today, Constable Benjamin Short said he pulled over a taxi driven by Sydney man MD Kowsar Ali early on November 4 last year.

An 18-year-old woman had just made an hysterical call to police from nearby Beverley Park, alleging she had been raped by a taxi driver.

Constable Short said Mr Ali told him: “I made mistake, she made mistake, but she made me interested in her.”

The 22-year-old has pleaded not guilty to raping the teenager, whose identity is protected, after picking her up from central Sydney shortly after midnight.

Under cross examination from Mr Ali’s barrister yesterday, the woman denied having consensual sex with Mr Ali or suggesting they could “get together” in the back seat.

The jury has been told the woman made the emergency call when she ran crying from the taxi, telling police the driver had raped her and then wiped her down with a T-shirt.

Constable Ashley Taylor told the court that when Mr Ali was read his rights, he responded: “But I want to say I made a mistake.”

Sergeant Scott Hallwood told the jury it was clear the young woman had consumed alcohol but said she “was not seriously intoxicated”.

He said she was “crying uncontrollably” and was “very distressed”.

Earlier, a friend of the alleged victim told the jury she had given the driver instructions to take the teenager home.

Another friend said the woman had thrown up in the toilets at the hotel and was in “no state to go back into the pub”.

The hearing continues.

Fatwa of the Month: Islam allows Rape and Wife Beating

Husband forcing his wife to have intercourse

Is it permissible for a man to force his wife or slave to have intercourse if she refuses?.

Praise be to Allaah.

The woman does not have the right to refuse her husband, rather she must respond to his request every time he calls her, so long as that will not harm her or keep her from doing an obligatory duty.

Al-Bukhaari (3237) and Muslim (1436) narrated that Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him)  said: “If a man calls his wife to his bed and she refuses, and he spends the night angry with her, the angels curse her until morning.”

If she refuses with no excuse, she is disobeying and is being defiant (nushooz), and he is no longer obliged to spend on her and clothe her.

The husband should admonish her and remind her of the punishment of Allaah, and forsake her in her bed. He also has the right to hit her, in a manner that does not cause injury. Allaah says (interpretation of the meaning):

“As to those women on whose part you see ill-conduct, admonish them (first), (next) refuse to share their beds, (and last) beat them (lightly, if it is useful); but if they return to obedience, seek not against them means (of annoyance). Surely, Allaah is Ever Most High, Most Great”

[al-Nisa’ 4:34]

Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) was asked what a husband should do if his wife refuses him when he asks for intimacy.

He replied:

It is not permissible for her to rebel against him or to withhold herself from him, rather if she refuses him and persists in doing so, he may hit her in a manner that does not cause injury, and she is not entitled to spending or a share of his time [in the case of plural marriage].” Majmoo’ al-Fataawa, 32/279.

And he was asked about a man who has a wife who is rebellious and refuses intimacy – does she forfeit the right to maintenance and clothing, and what should she do?

He replied:

She forfeits her right to maintenance and clothing if she does not let him be intimate with her. He has the right to hit her if she persists in being defiant. It is not permissible for her to refuse intimacy if he asks for that, rather she is disobeying Allaah and His Messenger (by refusing). In al-Saheeh it says: “If a man calls his wife to his bed and she refuses, the One Who is in heaven will be angry with her until morning comes.”

From Majmoo’ al-Fataawa, 32/278. The hadeeth was narrated by Muslim, 1736.

So the wife should be admonished first, and warned against defiance (nushooz) and of the anger of Allaah and the curse of the angels. If she does not respond, then the husband should forsake her in her bed, and if she does not respond to that, then he may hit her in a manner that does not cause injury. If none of these steps are effective, then he may stop spending on her maintenance and clothing, and he has the right to divorce her or to allow her to separate from him by khula’ in return for some financial settlement, such as giving up the mahr.

Similarly a slave woman does not have the right to refuse her master’s requests unless she has a valid excuse. If she does that she is being disobedient and he has the right to discipline her in whatever manner he thinks is appropriate and is allowed in sharee’ah.

And Allaah knows best.

Sixteen Christian Converts Arrested…and Beaten (Iran)

Tehran, 29 July (AKI) – Sixteen Iranians who converted from Islam to Christianity were arrested on Tuesday in Malakshahr, on the outskirts of the central Iranian city of Isfahan.

The six women, eight men and two adolescents who were arrested were assisting in a conversion ceremony and baptism of three new members of the church at a private house that had been transformed into an evangelical church.

The owners of the home, an elderly couple, were allegedly beaten up before they were locked up in an unmarked lorry.

In April, 10 Christian converts were arrested in Shiraz.

The official evangelical churches in Isfahan received orders not to allow any Muslims to attend their ceremonies and not to facilitate in any way the conversions.

Iranian law does not stipulate any punishment for those who convert from Islam to other faiths, even if the converts are subject to repression.

A few months ago, the government presented a bill which is currently being discussed in parliament, to include in the penal code the crime of “Ertedad” which is the act of abandoning the Muslim faith.

If the parliament does approve the law, the punishment for abandoning Islam will be the death penalty.

British Muslim Students: Killing for Islam is Okay?

A third of Muslim students in Britain believe killing someone in the name of religion is justified, a new poll claims.

The survey found that extreme Islamist ideology has a profound influence on a significant minority of Muslims on campuses across the country.

The findings will concern police chiefs, the security services and ministers, who are struggling with radicalisation among Muslim communities.

The YouGov poll was conducted for the Right-wing think tank, the Centre for Social Cohesion, at 12 universities, including Imperial College and Kings College London. It also found:

  • 40 per cent support the introduction of sharia into British law for Muslims
  • a third back the notion of a worldwide Islamic caliphate (state) based on sharia law
  • 40 per feel it is unacceptable for Muslim men and women to mix freely
  • 24 per cent do not think men and women are equal in the eyes of Allah
  • a quarter have little or no respect for homosexuals.

Although 53 per cent said that killing in the name of religion was never justified, compared with 94 per cent of non-Muslims, 32 per cent said that it was. Of these, 4 per cent said killing could be justified to “promote or preserve” religion, while 28 per cent said it was acceptable if that religion were under attack.

There was also sympathy for the view that Muslim soldiers in the Armed Forces should be allowed to opt out of operations in Muslim countries, with 57 per cent agreeing.

The report’s authors found that Islamic societies on campus, operating under the umbrella of the Federation of Student Islamic Societies, exert a strong influence on many of Britain’s 90,000 Muslim students. A quarter of them belong to Islamic societies and their views are often more extreme.

While three-fifths of society members said that killing in the name of religion was acceptable, an equal number of non-member Muslims said it was never justified. The security services have identified Islamist activism at universities acts as a possible “gateway” to violent extremism. Several terrorists and sympathisers began their extremist careers on campuses.

The authors of the report, “Islam on Campus”, lay much of the blame for extremism among Muslim students on the group Hizb ut-Tahrir, which seeks to build a worldwide Islamic state.

YouGov polled 600 Muslim students and 800 non-Muslim students at universities with a high number of Muslims.
